4. Additional Terms. These Terms of Use are the final and entire agreement between Penn and you on the subject matter set forth in this Agreement, and supersedes any previous discussions, negotiations, understandings or agreements on the subject matter set forth in the Terms of Use, except for the Online Content License Agreement. If there is an ambiguity or discrepancy between a term in the Online Content License Agreement and these Terms of Use, the term in the Online Content License Agreement shall prevail in meaning and interpretation, and shall be deemed to reflect the mutual agreement of Penn and you regarding such term. The terms in these Terms of Use are severable. If a term is held to be invalid or unenforceable, it shall be deemed severed and shall not affect the validity or enforceability of all other terms and the Terms of Use as a whole. Any waiver of any term of these Terms of Use, or a breach of a term of these Terms of Use, must be in writing and signed by the party waiving such term or such breach. A failure to enforce any term in these Terms of Use shall not constitute or be deemed to be a waiver of such term or any subsequent breach of such term.
